If you’ve tried mediation and have not been able to reach an agreement, you can then appeal to the First-tier Tribunal. Your mediation adviser will give you a certificate so you can register your appeal.
You can appeal without going through mediation, but you will still need a certificate to show you have spoken to an adviser before making the decision not to go through mediation.
You must appeal within two months of the decision, or one month of receiving the mediation certificate.
You can read about the powers these tribunals have on the GOV.UK website.
